Terms of Service

DVAB LABS Private Limited is a technology company incorporated under the Companies Act 2013 in Maharashtra, India. We operate dvablabs.com and the services and platforms accessible through it. By accessing or using our platform or services, or by placing any order, you agree to be bound by these Terms of Service in full. If you do not agree, you must not use the platform.

Platform Use

Our platform is intended exclusively for use by registered commercial entities: jewellery brands, retailers, designers, and manufacturers. You represent that you are at least 18 years of age, that you are legally authorised to enter into binding contracts on behalf of your business, and that your business operates in compliance with all applicable laws in the jurisdiction in which it is registered. DVAB LABS reserves the right to refuse access to any user or entity at its discretion without obligation to provide reasons.

Orders and Timelines

All timelines communicated on the platform or by our representatives are estimates only and are not contractual guarantees. Catalogue orders typically take 10 to 15 business days. Customisation orders typically take 15 to 20 business days. Custom design and bespoke orders carry timelines confirmed at order acceptance. Timelines are subject to manufacturer capacity, material availability, and circumstances beyond our reasonable control. DVAB LABS reserves the right to cancel or reject any order at its sole discretion. Where an order is cancelled by us prior to dispatch, any amount paid will be refunded within 14 business days.

Quality, Testing and Certification

We apply two rounds of internal quality verification prior to dispatch. Where confirmed at the time of order, lab-grown diamonds are accompanied by GIA, SGL, or IGI certification; 925 silver and gold jewellery carry Bureau of Indian Standards (BIS) hallmarking where applicable; gemstones and coloured stones are accompanied by certification from a recognised gemological laboratory as confirmed at order acceptance. The DVAB LABS Base Metals Report (DLBMR) and the DVAB LABS Two-Factor Authentication Certificate (DL2FAC) are internal quality inspection documents issued by DVAB LABS as part of our procurement process. They are not third-party certifications and do not constitute any independent or regulatory accreditation. They supplement, and do not replace, applicable third-party certifications. If a product does not match its confirmed specifications in terms of metal purity, stone specifications, dimensions, or certified parameters, we will at our discretion replace the product or issue a full refund for that item.

Pricing and Payment

All prices are quoted in Indian Rupees unless otherwise stated and are exclusive of applicable taxes including GST unless explicitly stated as tax-inclusive. Final pricing is confirmed at order acceptance and may vary from indicative prices on the platform owing to commodity price movements, stone grading variables, and order specifications. Default payment terms are full advance unless a separate credit arrangement has been confirmed in writing by an authorised representative of DVAB LABS. Late payments carry interest at 18% per annum from the due date. We reserve the right to suspend or cancel orders where payment is not received in accordance with agreed terms.

Returns and Refunds

Returns are accepted only in the following circumstances: the product does not match its confirmed specifications; the product arrives damaged in transit; or the wrong product has been shipped. Return requests must be raised within 7 calendar days of delivery and must be accompanied by photographs and an unboxing video documenting the condition of the product at receipt. Custom design orders, bespoke orders, and orders manufactured to client-submitted specifications are non-returnable and non-refundable except where the product is defective or materially fails to match agreed specifications. We do not accept returns for change of mind, for delays attributable to factors outside our control, or where the product has been altered, used, or damaged after receipt by the buyer. Approved refunds are processed within 14 business days of verification of the returned product.

Intellectual Property

All content on dvablabs.com and our platform (including but not limited to text, design, code, catalogue imagery, and branding) is the property of DVAB LABS Private Limited and is protected under the Copyright Act 1957 and applicable Indian intellectual property law. You may not reproduce, redistribute, or use any such content without our prior written consent. Designs and specifications submitted by you to DVAB LABS for the purpose of manufacturing remain your property. By submitting them you grant DVAB LABS a limited, non-exclusive, non-transferable licence to use them solely for the purpose of fulfilling your order. Where DVAB LABS creates original designs as part of a custom design service, ownership of those designs will be confirmed in writing at the time of engagement. In the absence of a written agreement, all designs created by DVAB LABS remain the property of DVAB LABS Private Limited.

Network Capacity and Production Figures

Figures displayed on our platform relating to manufacturing throughput and sourcing capacity represent the aggregate estimated capacity of our manufacturer and supplier network as a whole. They are not guarantees of output, availability, or delivery for any specific order. All figures are indicative of network scale and are subject to market conditions, commodity availability, and manufacturer capacity at the time of order.

Past Associated Brands

References on this platform to brands including Tanishq, CaratLane, Malabar Gold and Diamonds, PNG Jewellers, ORRA Fine Jewellery, Damas Jewellery, GRT Jewellers, and Zoya by Tata are made under the heading "Past Associated Brands." These references reflect indirect supply chain relationships: our founders' family business has supplied gold jewellery manufacturing machinery to manufacturers who supply these brands. DVAB LABS Private Limited and its founders do not claim, and have not had, any direct commercial relationship with these brands in connection with DVAB LABS. These brands have not endorsed, certified, approved, or verified DVAB LABS in any capacity.

Historical Figures

References on this platform to figures such as "2,000+ orders since 1970" and "130+ cities and countries reached" are attributable to the founders' family business and its network relationships accumulated over approximately 50 years. These figures are not the direct order history of DVAB LABS Private Limited, which was incorporated in December 2025. They are provided as context for the industry knowledge and relationships that DVAB LABS is built on and should not be construed as the operational history of DVAB LABS itself.

Limitation of Liability

To the maximum extent permitted by Indian law, the total liability of DVAB LABS Private Limited arising from or in connection with any order or use of the platform is limited to the invoice value of the specific order giving rise to the claim. DVAB LABS is not liable for any indirect, consequential, special, incidental, or punitive losses, including loss of profit, loss of business, loss of data, or loss of reputation, whether or not we were informed of the possibility of such losses. Nothing in these terms limits our liability for fraud or for any other liability that cannot lawfully be excluded or limited under Indian law.

Platform Availability

DVAB LABS does not warrant that the platform will be available at all times, free of errors, or uninterrupted. We may suspend access for maintenance, updates, or reasons outside our control without prior notice. We are not liable for any loss or inconvenience arising from platform unavailability.

Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of India. Any dispute arising from or in connection with these terms or any order placed through the platform shall first be subject to a 30-day good-faith negotiation period. If unresolved, the dispute shall be referred to sole arbitration under the Arbitration and Conciliation Act 1996. The seat of arbitration shall be Mumbai, Maharashtra. Proceedings shall be conducted in English. The arbitrator's award shall be final and binding on both parties.

Changes

We may update these terms at any time. The revised date at the top of this page will reflect any changes. Material changes will be communicated to active users by email or notice on the platform. Continued use of the platform after changes are published constitutes acceptance of the revised terms.
